ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 319(2), 318(4), 318(2) and 351(2) of BNS, in Crime No.9 of 2026 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the 1st accused approached the defacto complainant and introduced herself as Bank employee and by promising to arrange a bride and a bank job for him, she received a sum of Rs.70 lakhs and 15 sovereign of gold from the defacto complainant and thereby, cheated him. According to the prosecution, when the defacto complainant demanded the 1st accused to repay the said amount, she had given a phone number of so called Shanmugasundaram, bride's father. He has returned a sum of Rs.90,000/- on various occasion, however, he failed to return the entire amount as promised by him. Thereafter, the defacto complainant 2/5

came to know that the person talked to him as Shanmugasundaram is none other than the petitioner. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that in this case, totally, there are three accused and the petitioner herein is arrayed as A2. The petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the defacto complainant gave all money and jewels to the 1st accused and he neither received any money nor jewels from the defacto complainant and he has no nexus with the 1st accused. Therefore, he prayed this Court to grant anticipatory bail.

4.The learned Counsel for State of Tamil Nadu (Crl. Side) would submit that the investigation is going on.

5.Considering the nature of offence and also taking note of the amount involved in this case, this 3/5

Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
