Writ Petition is filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, directing the respondent to grant permission and provide police protection to the petitioner for conducting Vinayagar Chathurthi Festival Scheduled on 04.09.2016 to 10.09.2016 at Vanamoorthy Amman Temple, Thannoothu and Idols Procession Scheduled on 10.09.2016 upto the place of immersion of Vinayagar Idols at Papanasam on the basis of the representation of the petitioner dated 05.08.2016.

The present Writ Petition has been filed for issuance of a Writ of Mandamus, directing the respondent to grant permission and provide police protection to the petitioner for conducting Vinayagar Chathurthi Festival Scheduled on 04.09.2016 to 10.09.2016 at Vanamoorthy Amman Temple, Thannoothu and Idols Procession Scheduled on 10.09.2016 upto the place of immersion of Vinayagar Idols at Papanasam on the basis of the representation of the petitioner dated 05.08.2016.

2. Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondent. By consent, the writ petition itself is taken up for final disposal.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

The learned counsel appearing for the petitioner would submit that the Vinayagar Chathurthi festival is being conducted by the villagers regularly in order to promote harmony among public; that a representation was given to the respondent, but, however, the same was not considered by the respondent so far and hence, the petitioner is before this Court with this writ petition.

4.1. The learned counsel appearing for the petitioner would further submit that as the Vinayagar Chathurthi festival is conducted in a peaceful manner by the villagers, there will be no untoward incident on account of this festival.

5. The learned Additional Government Pleader for the respondent would submit that the representation of the petitioner dated 05.08.2016 will be considered and suitable orders will be passed thereon.

6. Once a representation has been received by the respondent, it is their bounden duty to decide on the same. Therefore, the respondent is directed to consider the representation of the petitioner dated 05.08.2016 and pass appropriate orders thereon on merits and in accordance with law on or before 02.09.2016. With the above direction, this Writ Petition is disposed of. No costs.
