ORDER

This petition is filed seeking writ of mandamus, directing the respondents to enquire the complaint of the petitioner and to take action against the accused persons, based upon the complaint given by the petitioner dated 28.09.2020.

2.The case of the petitioner is that the complaint was made on 28.09.2020 through RPAD to the respondents, but so far no case has been registered and no action has been taken. 3.When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents would submit that based upon the complaint given by this petitioner, enquiry was undertaken, but in the complaint, the petitioner has not disclosed the correct particulars and the names of the counter complainants. So, the respondents are not in a position to make enquiry. The petitioner did not appear before the Enquiry Officer also. On that ground, it came to be closed today ie., 23.09.2021. 4.It appears that it is a money transaction between the petitioner and the counter complainants. W.P.(MD)No.16267 of 2021 his remedy through appropriate civil proceedings. The question of giving complaints and making enquiry may not be proper. I find no merit in this petition.

5.This petition deserves to be dismissed and accordingly, it is dismissed. No costs.
