ORDER : The Court made the following order :- The petitioner/A.1, who was arrested and remanded to judicial custody on 17.04.2026 for the offences punishable under Sections 296(b), 118(1), 351(3) @ 296(b), 109 of BNS, in Crime No.94 of 2026, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 10.04.2026 at about 03.00p.m., while the defacto complainant and his friends were consuming alcohol, the accused persons assaulted them. Hence, the complaint.

3. The learned Counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent would submit that due to the assault made by the accused persons, the defacto complainant got injured. He would further submit that the petitioner has 10 previous cases to his credit. Though the injured persons have already been discharged from the hospital, considering the grave nature of offence, he strongly opposed to grant bail to the petitioner.

4.In response, the learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Though the petitioner is having previous cases, most of the cases were registered prior to the year 2018. He would further submit that the injured persons have already been discharged from the hospital. Therefore, prayed to grant bail for the petitioner.

5.Considering the above facts and circumstances, nature of offence levelled against the petitioner and also the facts that the petitioner is in judicial custody from 17.04.2026 and that the injured were discharged from the hospital, this Court is inclined to grant bail to the petitioner subject to the following conditions: 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vadipatti.

(i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall stay at Trichy and report before the Cantonment Police Station daily at 10.30 a.m., until further orders;

(iii)the petitioner shall not tamper with evidence or witness;

(iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

(vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023. (K M S J) 27.05.2026 PNM 4/6
