ORDER

The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offence under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) and 109 of BNS @ under Sections 147, 148, 294(b), 323, 324, 506(ii) and 307 IPC r/w Section 4 of TNPHW Act, 2002, in Crime No.223 of 2026 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that there existed temple festival dispute between the parties. On 20.05.2026, the accused persons abused the defacto complainant with filthy language and criminally intimidated her and also attacked her, due to which, she sustained injury. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Counsel for the State of Tamil Nadu (Crl.side) would submit that the petitioner along with other accused have abused and attacked the de-facto complainant and others and the injured is still in hospital. He would also submit that the co-accused have already been arrested and they are in judicial custody. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the fact that investigation is pending and further, the injured is still in hospital and the co-accused are in judicial custody, this Court is not inclined to grant bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. 27.05.2026 cmr To 1.The Inspector of Police, Kulithalai Police Station, Karur District.
