ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 13.05.2026 for the offences punishable under Sections 296(b), 115(2), 105 BNS, in Crime No.180 of 2026, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 12.05.2026 at about 04.00p.m., with regard to the usage of water there was a wordy altercation between the deceased and the petitioner. On the same day, at about 07.15p.m., the petitioner scolded the deceased in filthy language, assaulted him with stick and caused head injuries, thereby, the deceased died. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, prays to release him on bail. 4.The learned Counsel for State of TN (Crl.Side) would submit that in this case, the deceased died, due to the assault made by the 2/4

petitioner. In this case, investigation is in nascent stage and Post Mortem Certificate is yet to be received.

5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the fact that Post-mortem Certificate has not been received in this case, this Court is not inclined to grant bail to the petitioner at the nascent stage of investigation. 6.In the result, this Criminal Original Petition is dismissed.
