This writ petition has been filed by the petitioner seeking direction to the the respondents to grant permission to stage demonstration on 26.06.2023 at Opposite to Veterinary Hospital, Vavvalthottam, Y.Othakadai, by considering the petitioner representation dated 15.05.2023.
2.Mr.B.Nambiselvan, learned Additional Public Prosecutor takes notice for the respondents.
3.The learned counsel for the petitioner would submit that the petitioner has sent a representation to the respondent police, on 15.05.2023, seeking permission to stage a protest against the Government. The same was rejected by the third respondent. Challenging the same the present writ petition has been filed. 4.The petitioner has sent a representation seeking permission to conduct demonstration on 26.06.2023 near Y.Othakarai condemning inaction on the part of the Government over the atrocities against their communal people. The above said representation was rejected by the 2/5
order dated 23.06.2023, stating that no proper reason, for which the above said demonstration is going to be conducted is mentioned in the representation. It is also stated that it is heavily traffic and congested area. The above said representation was not made on behalf of the above said association, but by an individual.
5.Without proper facts and circumstances the above said representation has been made. Let fresh representation be given by the petitioner giving alternative place, time and reason for the above said proposed demonstration, within a week from the date of receipt of a copy of this order to the respondent police. It is made clear that the representation must be sent on behalf of the Association and not by the individual, in proper form. On receipt of such representation, the same shall be considered by the respondent police on its own merits and in accordance with law, by imposing any conditions as deemed it fit, which are reasonable in nature.
6.With the above said directions, this writ petition stands disposed of. No costs.
