Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order dated 17.03.2017 in 1/MIKE/L3PS/2017 passed by the 2nd respondent and quash the same and consequently direct the respondents 2 & 3 to give adequate Police protection to us to conduct the cultural event scheduled to be held on 08.04.2017 to 12.04.2017 particularly "Aadalulm Padalum" dance program on 09.04.2017 in pursuance to the 65th Annual Festival of Murugan Theerthakavadi situated in Seerengagoundanpudur, Thangachiyammapatti Village, Dindigul District. For Petitioner : Mr.B.Vinoth Balan For Respondents : Mr.T.S.Mohammed Mohideen, Additional Government Pleader.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the impugned order dated 17.03.2017 passed by the second respondent and quash the same and also for directing the respondents 2 and 3 to give necessary permission for conducting the programmes https://hcservices.ecourts.gov.in/hcservices/

mentioned therein, by way of issuing a writ of certiorarified mandamus.

2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for the respondents. 3.It is seen from the records that on 17.03.2017, a representation has been given. But the same has been rejected by the second respondent simply on the ground of law and order problem. The reason given by the second respondent is not proper. Under the said circumstances, this Court is inclined to pass the following order.

4.In fine, this writ petition is allowed in part without costs and the impugned order dated 17.03.2017 passed in 1/MIKE/L3PS/2017 by the second respondent is quashed. The second respondent is directed to consider the representation alleged to have been given by the petitioner afresh and pass suitable orders on merits within a period of two days.
