Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to take necessary action to continue the enquiry in pursuant to the communication in Na.Ka.5587/A1/2012, dated 17.12.2012 based on the petitioner's representation, dated 02.12.2012 followed by a reminder, dated 29.06.2015. ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent.

2. The present Writ Petition has been filed by the petitioner seeking a direction to the respondent to take necessary action to continue the enquiry in pursuant to the communication in Na.Ka.5587/A1/2012, dated 17.12.2012, based on the petitioner's representation, dated 02.12.2012, followed by a reminder, dated 29.06.2015.

3. The petitioner said to have filed an application before the respondent on 02.12.2012 seeking to cancel the sale deed executed by one Dasa Goundar before the Sub-Registrar, Ariyalur. In the above application, enquiry notice was ordered on 17.12.2012. Thereafter, no enquiry was conducted. Hence, the petitioner made a representation before the respondent once again on 29.06.2015 seeking to proceed with the matter. Despite that, no order has been passed.

In the above circumstances, without going into the merits of the matter, I direct the respondent to consider the petitioner's application dated 02.12.2012 followed by a reminder, dated 29.06.2015 and pass orders on the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order, after giving notice to all the necessary parties.

With the above direction, this Writ Petition is disposed of. No Costs.
