PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 3 more particularly the first respondent to consider the petitioner's representation dated 30.06.2022 on merits and in accordance with law and subsequently convene a peace committee meeting between the petitioner and the respondents 4 to 6 for settling the issue amicably between themselves in respect of Om Sri Karuppasamy Sri Kannimaar Sri Veeru Chinnammal Thirukovil situated at Koduvilarpatti Theni District. This petition has filed filed for issuance of writ of mandamus directing respondent Nos.1 to 3, more particularly, the first respondent herein to consider the petitioner's representation dated 30.06.2022 on merits and in accordance with law and subsequently, convene a peace committee meeting between the petitioner and respondent Nos.4 to 6 to settle the issue amicably between themselves in respect of the Temple.

2. Heard the learned counsel appearing for the petitioner. 2/4

3. The learned Additional Public Prosecutor appearing for the respondent Police would submit that it is purely a civil dispute and that the petitioner has to approach only before the revenue authorities and not before the respondent Police.

4. It appears that already there was a dispute between the petitioner and the private respondents with regard to conduct the festival in the Temple and the said dispute is purely civil in nature. Hence, the relief sought for by the petitioner cannot be granted by this Court. Therefore, the petitioner has to approach only before the Revenue Authorities.

5. With the above observation, this Writ Petition stands disposed of. No cost. Liberty is granted to the petitioner to approach the concerned Civil Court for getting appropriate remedy. 07.02.2024 NCC:yes/no Index:yes/no Internet:yes/no TSG To 1.The Superintendent of Police, Theni District.
