PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to survey and demarcate the boundaries in respect of the land belonging to the petitioner's mother Pitchai Ammal in Re Survey Number 138/9 old Survey Number 138/9A1A and New Survey Number 209/11 to an extent of 3026 sq.ft (6 Cents 410 Sq.ft) out of 2 acre and 24 cents situated in Kodikulam Village, Thamaraipatti Sub Division, Madurai North Taluk, Madurai District, and issue separate patta, based on the petitioner's representation, dated 22.01.2025.

ORDER

The petitioner herein seeks a direction to first respondent to survey the property situated in New Survey Number 209/11 to an extent of 3026 sq.ft., at Kodikulam Village, Thamaraipatti Sub Division, Madurai North Taluk, Madurai District, by considering his representation, dated 22.01.2025.

2. According to the petitioner, the above mentioned property was purchased by petitioner's mother Pitchai Ammal under a registered sale deed, dated 26.12.1991. Subsequently, patta for the subject property was also issued in the name of the petitioner's mother in Patta No.724. The petitioner's mother died on 30.09.2017. Thereafter, the petitioner submitted an online application on 22.01.2025 vide Application No.2025/N123/24/010575, seeking survey of the subject property. The same has not been considered. Hence, the petitioner has come before this Court.

3. The Government Advocate, who takes notice for respondents 1 to 3, would submit that the online application submitted by the petitioner would be considered on its own merits.

4. In view of the above, without expressing any opinion on the merits of the matter, first respondent is directed to consider the online application of the petitioner, dated 22.01.2025, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to petitioner, private respondents 4 to 8 and other interested parties.

5. Accordingly, the Writ Petition is disposed of. No costs. 24.06.2025
