ORDER
This petition has been filed seeking for a direction to the respondent to expedite the investigation in Crime No.15 of 2018. 2.Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the official respondent. 3.The learned Additional Public Prosecutor appearing for the respondent would submit that earlier this Court had directed to file the status report with regard to progress in investigation and also directed the respondent to examine the witness and the persons from whom the accused had collected money and not repaid. The learned Additional Public Prosecutor would further submit that based on the direction, the investigation has been taken up by the respondent and statements have been taken from 16 witnesses.
He would also submit that the petitioner has filed a document in the nature of Bank transaction to the tune of Rs.8,50,000/- only and that the petitioner did not give any proof for the amount of Rs.1,50,000/-. He would further submit that the allegation is that the accused has cheated so many persons to the tune of Rs. 3 Crores. However, no one preferred any complaint before the respondent police. Further, the petitioner could not give any proof regarding the nature of investment in the said Company and during investigation, it came into light that the petitioner also received dividends for three months from the date of investment in the accused company. Further, the accused had filed a civil suit in O.S.No.308 of 2018, before the https://hcservices.ecourts.gov.
District Munsif Court, Trichy, praying to restrain the defendants from interfering with the peaceful possession and enjoyment of the business. He would further submit that investigation is still going on.
4.Status recorded. The respondent is directed to complete the investigation as expeditiously as possible and file the final report preferably within a period of two months from the date of receipt of a copy of this order.
5.With this direction, this Criminal Original Petition stands disposed of.
