ORDER

The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offence under Section 309(4) of BNS and Section 3 of Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992, in Crime No.581 of 2026 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that there was a money dispute between the parties, due to which, the petitioner along with the other accused persons attacked the vehicle belonging to the defacto complainant and and took the amount brought by him. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Counsel for State of Tamil Nadu (Criminal Side) appearing for the respondent police would submit that the petitioner is having seven previous case, out of which, one case is similar in nature. 5.Considering the facts and circumstances of the case and also considering the offences alleged, which are serious in nature and taking note of the damages allegedly caused and that the petitioner is involved in seven previous cases, of which, one case is similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed. 27.05.2026 mm To 1.The Judicial Magistrate No.4, Tirunelveli.
