PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to stop the eviction process in S.No.416/1, Vellanoor Village, Kulathur Taluk, Pudukkottai District until the disposal of the Civil Suit in O.S.No.76 of 2023 on the file of the District Munsif Court, Keeranur and also till the final disposal of the petitioner's application dated 22.05.2026 for land transfer as stipulated in RSO 24 of Tamil Nadu Government.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present writ petition seeking the issuance of a Writ of Mandamus directing the respondents to defer the eviction proceedings in respect of Survey No. 416/1, Vellanoor Village, Kulathur Taluk, Pudukkottai District, until the disposal of O.S. No. 76 of 2023 pending on the file of the District Munsif Court, Keeranur, and until the final disposal of the petitioner's application dated 22.05.2026 seeking transfer of land under Revenue Standing Order (RSO) 24.

2. According to the petitioner, she is conducting regular vocational training programmes in the said survey field and claims that the patta stands in her name. It is her contention that the fourth respondent has initiated steps to evict her from the property at the instance of certain third parties. Earlier, the petitioner had challenged the eviction proceedings by filing W.P.(MD) Nos. 12468 of 2019, 24380 of 2024, and 9383 of 2025. In those proceedings, this Court directed the authorities to follow due process of law under the relevant Revenue Standing Orders before taking any action. The petitioner has also instituted O.S. No. 76 of 2023 before the District Munsif Court, Keeranur, seeking to restrain the respondents from interfering with her possession.

3. The relief sought in the present writ petition is a direction to the respondents not to proceed with the eviction process until the disposal of the said civil suit. Merely because the petitioner has instituted a civil suit seeking declaratory and consequential reliefs, this Court cannot grant a blanket order restraining the authorities from proceeding in accordance with law until the suit is finally decided. If the petitioner requires urgent protection, it is open to her to 3/6

approach the Civil Court and seek appropriate interim relief, including an order of temporary injunction.

4.Accordingly, the writ petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
