Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first and second respondents to revoke the order of deemed suspension and re-instate the petitioner into service based on enquiry report of the second respondent vide Na.Ka.No.A2.793/2020 dated 15.12.2021 and based on the petitioner's representation dated 26.12.2021 before the first respondent. 1/5

ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The petitioner herein seeks for a Mandamus for direction to the respondents to revoke the order of suspension and reinstate him back into service based on the enquiry report in Na.Ka.No.A2.793/2020, dated 15.12.2021, passed by the second respondent herein.

3. Today, when the matter was taken up for hearing, the learned Standing Counsel appearing for the respondents submitted that by the proceedings in Na.Ka.No.A2/141/2021, dated 15.12.2021, the second respondent herein had sent a proposal to the first respondent for revocation of the suspension order and that the first respondent would pass final orders very shortly. 2/5

4. The learned counsel for the petitioner submitted that he would be satisfied, if the first respondent is directed to pass orders on the proposal of the second respondent within a stipulated time.

5. In the light of the submissions made by the respective counsels, there shall be a direction to the first respondent herein to pass final orders on the proposal of the second respondent in Na.Ka.No.A2/141/2021, dated 15.12.2021, within a period of two (2) weeks from the date of receipt of a copy of this order.

6. This Writ Petition is ordered accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed. 01.08.2022 Index : Yes / No Internet : Yes/ No Lm/btr 3/5
