The petitioner, who is arrayed as A1 was arrested, on 20/06/2022 and remanded to judicial custody for the alleged offences punishable under sections 420, 465, 468, 470, 474, 419, 120-B and 34 of IPC, in Crime No.1 of 2019 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the de-facto complainant lodged a complaint stating that he was introduced to A1 and he informed that he has appeared for TNPSC examination. At that time, A1 told him that A2 and A3 are known to him. He can arrange a Government job through them. On 31/03/2014, A2 and A3 demanded Rs. 5,00,000/- for the purpose of getting appointment. On 10/04/2014, Rs.2,00,000/- was paid to A2 and A3. Later, it also came to know that similarly so many persons paid money to A2 and A3 for the purpose of getting appointment.
Later, A2 and A3 handed over fake appointment orders. When contacted A2 and A3, they stated that they have to pay Rs.1.25 crores to various persons. On the basis of the complaint, this case has been registered. This petitioner was arrested, on 20/06/2022 and ever-since, he is in custody.
3.Seeking bail, this petition has been on the ground that no material has been collected during the course of investigation to implicate this petitioner also into the offence. It is also stated that he is ready to settle the amount stating that A2 and A3 are responsible for the above said issue and he was only introduced A2 and A3 to the de-facto complainant and nothing more done by him.
4.Heard both sides.
5.The learned Additional Public Prosecutor would submit that more than Rs.1.25 crores is involved in this matter and no amount has been also settled.
6.Perusal of the CD file shows that sufficient material has been collected to show the preparation of fake appointment orders and issued to various persons. The earlier bail application came to be dismissed by the trial court, considering the magnitude of the offence. Getting money with a promise to procure job in Government departments, which is a very serious offence. But the fact remains that statutory period going to be over
within three day. The petitioner was arrested, on 20/06/2022 and ever-since, he is in custody. No final report has been filed so far before the concerned court. 7.So without going into other aspects, this court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Trichirapalli and on further condition that the petitioner shall report before the respondent police daily at 10.30 am until further orders. 18/08/2022 Index:Yes/No Internet:Yes/No er Note : In view of the present lock down owing to COVID-19 pandemic, a web copy of the order may be utilized for official purposes, but, ensuring that the copy of the order that is presented is the correct copy, shall be the responsibility of the advocate/litigant concerned.
