Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order of the second Respondent in Na.Ka.No.26847/ 2019-2/ B-1 dated 13.07.2019 and consequential impugned order of the 2nd Respondent in Na.Ka.No.49739/2019-1/B1 dated 28.01.2020 and quash the same as illegal and consequently direct the Respondents to follow the procedure prescribed under the Tamil Nadu Hindu Religious and Charitable Endowments Administration Service Rules for granting promotion as Deputy Commissioners to the Assistant Commissioners in the Respondent Department.

ORDER

It is represented by the learned counsel for the respondent that the claim of the petitioners herein was considered by the respondents, after filing this Writ Petition and accordingly, petitioners 2 to 7 have already been promoted to the post of Deputy Commissioner and in so far as petitioners 1 and 8 are concerned, there are disciplinary proceedings pending against them and because of the said reason, their case could not be considered for promotion to the post of Deputy Commissioner of H.R.& C.E Department.

2. The learned Additional Government Pleader also placed before this Court, the relevant orders vide G.O.(2D)No.08, dated 25.04.2022 and G.O.(D)No.40, dated 13.02.2024, issued by the Tourism, Culture and Religious Endowment Department respectively.

3. In the light of the above, the cause in the Writ Petition does not survive and the same is accordingly dismissed, granting liberty to the petitioners to agitate afresh, if still they have got any grievance. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
