ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ on hand has been instituted to direct the respondents 1 to 3 to take action against the respondents 4 to 24 for their illegal operation of coir pith industries and to consequently shut down these industries. 2.The third respondent/the Tahsildar, Palani has conducted a field inspection. With regard to encroachments, the revenue authorities conducted a survey and informed the same to the Public Works Department and Water Resources Organization. The boundaries were fixed during the course of the survey. It was found that there is no encroachment in the water body. However, encroachments identified in the Amaravathi river side in 3/6

Madathukulam are directed to be removed by the Assistant Engineer, Water Resources Organization.

3.Accordingly, the Tahsildar, Palani has already addressed a letter to the Water Resources Organization to remove the encroachments in the water body.

4.Asfar as the allegations raised by the petitioner regarding the extraction of river water through a pipe line is concerned, they were found to be incorrect, since permission was granted only to some farmers to extract water from their own wells.

5.In view of the above facts and circumstances, the official respondents are directed to ensure that the encroachments in the water body are removed by following the procedures as contemplated under the relevant statutes and rules in force. The revenue authorities shall ensure that such removal is carried out by the officials of the Water Resources Organization. 4/6

6.With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
