For Respondent : Mr.R.M. Anbunithi Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.23 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406, 420 and 120B IPC in Crime No. 23 of 2022 on the file of the respondent police, seeks anticipatory bail.

3. The case of the prosecution is that the petitioner and other accused said to have canvassed the peoples about the job in abroad. On the basis of the promise, several persons have paid amount. As per the FIR 120 persons have paid the amount totally about https://www.mhc.tn.gov.in/judis

Rs.60,00,000/-. After collecting the amount, the above said office was found locked. Hence,the complaint.

4. The learned counsel for the petitioner submitted that so far as this petitioner is concerned, he is relative to the first accused and made only an advertisement.

5. The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner and other accused have cheated 125 people about one Crores of Rupees promising getting job in abroad. He would further submit that the petitioner herein apart from making advertisements invited the people to pay the amount. He further submitted that some of the accused were arrested and remanded to judicial custody.

6. Considering the serious nature of allegations made against the petitioner and that the some of accused persons were arrested and remanded to judicial custody, the custodial interrogation of the petitioner is necessary and hence, this Court is not inclined to grant anticipatory bail to the petitioner.
