ORDER

This Criminal Miscellaneous Petition has been filed to suspend the sentence of imprisonment imposed on the petitioner / accused vide judgment made in Crl.A No. 01/2023 dated 26.11.2025 on the file of Learned Additional District Judge, Kuzhithurai confirming the judgment dated 09.12.2022 made in STC No.1023 of 2017 on the file of the learned Judicial Magistrate No.I, Kuzhithurai, till the disposal of the above revision case.

When the matter is taken up for hearing, the learned counsel for the petitioner as well as the respondent submitted that the matter has been settled between the parties and that the amount has been paid by the petitioner to the respondent. 3.The learned counsel for the respondent has no objection to suspend the sentence against the petitioner.

4.It is evident to record that, this Court, in Crl.M.P(MD).No.20201 of 2025, has already granted suspension of sentence to the petitioner by imposing condition to deposit 50% of the cheque amount. Since the same has not been complied with, the present petition came to be filed.

5.Considering the above facts and circumstance of the case, this Court is inclined to grant suspension of sentence.

6.In the result, the Criminal Miscellaneous Petition is ordered. Accordingly, the relief of suspension of sentence is granted to the petitioner on the following conditions, till the disposal of the above criminal revision case:- (i) The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate I, Kuzhithurai; (ii) The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; and (iii) The petitioner shall appear before the trial Court once in a month i.e., on the first working day of every English calendar month at 10.30 a.m., until further orders and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 B.N.S.S. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
