For Respondent : Mr.M.Karunanithi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition as the petitioner shall appear and sign before the respondent police station daily morning at 10.00a.m. and shall sign for 30 days and thereafter shall appear on summons imposed in Crl.MP.No.1498 of 2025 dated 05.06.2025 on the file of the learned Principal Sessions Judge, Sivagangai . 1/4

ORDER : The Court Made the following order :- This petition has been filed to modify the condition as the petitioner shall appear and sign before the respondent police station daily morning at 10.00a.m. and shall sign for 30 days and thereafter shall appear on summons, imposed in Crl.MP.No.1498 of 2025 dated 05.06.2025 on the file of the learned Principal Sessions Judge, Sivagangai .

2. The learned counsel for the petitioner would submit that this petitioner was arrested on 09.05.2025. This petitioner had filed a bail application before the learned Principal Sessions Judge, Sivagangai and the Trial Court granted bail to the petitioner by an order dated 05.06.2025 with certain conditions. The said condition is as follows :

'' The Petitioner shall appear and sign before the Respondent Police Station daily morning at 10.00a.m. and shall sign for 30 days and thereafter, shall appear on summons. ''

3. He further submits that the petitioner is the sole bread winner of his family. For the said condition, the petitioner is unable to carry out his normal day to day life, and he find it very difficult to appear and sign before the respondent police station situated in different districts daily at 10.00a.m. Hence, the petitioner seek 2/4

indulgence of this court by modifying the said condition imposed against him. Hence, he prays for modification of the said condition.

4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Original Petition.

5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition in the order made in Crl.MP.No.1498 of 2025 dated 05.06.2025. Accordingly, condition is modified as ''The Petitioner shall appear and sign before the Inspector of Police, Natham Police Station, Dindigul District daily at 10.00a.m. until further orders.''. The other conditions shall remain unaltered.
