Mr.D.Sasikumar, Additional Government Pleader, for R-1 COMMON ORDER Even though these writ petitions were originally filed seeking a writ of mandamus, the petitioners are now seeking to alter the prayer and are giving up the original relief sought.
2. Today, when these matters are taken up for hearing, the petitioners are only seeking a direction to the 1st respondent to register the settlement deed.
3. The learned Additional Government Pleader appearing for the 1st respondent submitted that, since it is an undivided share, the 1st respondent cannot register the settlement deed. However, the petitioners rely on the judgment of the Additional Sub Court, Dindigul. In the said
suit, the 2nd respondent was declared entitled to 24 cents, and the remaining portion was declared to be the entitlement of the petitioner.
4. Accordingly, these writ petitions are allowed. The the 1st respondent is directed to register the settlement deed in light of the judgment and decree dated 22.12.2023 passed in O.S. No. 190 of 2016 on the file of the Additional Sub Court, Dindigul. This exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petitions are closed.
