Respondents Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the fourth respondent through her proceedings No.127/Pe.Tha.C.Ma/2026, dated 19.05.2026 quash the same as illegal and consequently to direct the respondents to grant emergency leave (parole) for the period of 20 days leave from 22.05.2026 to 11.06.2026 to the petitioner's mother namely Sivanammal @ Sivamalar, W/o.Kasimayan in Prisoner ID 145646, who is in Central Prison, Madurai, in order to attend the ear piercing of her grand daughter namely S.Sivani, scheduled to be held on 28.05.2026.

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the impugned proceedings of the 4th respondent made in No.127/Pe.Tha.C.Ma/2026, dated 19.05.2026 and for a consequential direction to the respondents to

grant emergency leave to the convict, who is presently serving sentence at Central Prison, Madurai.

2. Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) appearing on behalf of the respondents.

3. The petitioner is the daughter of the convict. The convict is undergoing sentence at Central Prison, Madurai, for an offence under the NDPS Act. A representation was made by the petitioner seeking emergency leave on the ground that an ear-piercing ceremony has been arranged for the petitioner's daughter and the convict, being the grandmother, has to attend the said function. The said representation came to be rejected by the 4th respondent through the impugned proceedings dated 19.05.2026. Aggrieved by the same, the present Writ Petition has been filed before this Court.

4. In the considered view of this Court, the ground, on which the petitioner has sought emergency leave is not covered under the Rules and therefore, the 4th respondent rightly rejected the representation. We do not

see any illegality in the order passed by the 4th respondent warranting the interference of this Court. Accordingly, this Writ Petition stands dismissed. Consequently, the connected Miscellaneous Petition is closed. No costs.
