Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a mandamus directing the respondents to re-fix/revise the scale of pay of the petitioner in the post of Superintendent based on the G.O.(Ms)No.146 Transport (C) Department dated 30.11.2015, w.e.f. 03.05.2008, up to the date of his retirement and also to revise his pension benefits, based on such revised scale of pay payable to him on the month of his retirement i.e., April,14 and consequently to pay him revised monthly pension, along with arrears of monthly pension and commuted value of 1/4

pension, together with 18% p.a within a time frame as may be fixed by this Court.

ORDER

The instand writ petition has been filed seeking a mandamus to refix the pay scale of the writ petitioner based on G.O.Ms.No.146, Transport (C) Department, dated 30.11.2015, w.e.f. 03.05.2008, till the date of his retirement namely 30.04.2014 and revise his pensionary benefits and pay the commuted value of the pension with 18% interest.

2. The petitioner has made a representation to the first respondent herein dated 22.11.2023, which has been acknowledged by him. As there is no response, the present writ petition has been filed.

3. Considering the above said fact, the first respondent herein is directed to consider the representation of the petitioner, dated 22.11.2023 2/4

and pass the orders on merits in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above said observation, this writ petition is disposed of. No costs.
