ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 22.04.2026 for the offences punishable under Section 103(1) of BNS, in Crime No.222 of 2026, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and the deceased were husband and wife and that their marriage took place in the year 2022. It is alleged that the petitioner came to know that the deceased, namely his wife, had already married twice earlier and, by suppressing the same, had married the petitioner. When the petitioner questioned her regarding the same, the deceased did not give any proper reply. While so, on 22.04.2026, the petitioner allegedly attacked the deceased on her head with a crowbar while she was sleeping, due to which she died on the spot. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the deceased had two previous marriages and having children through those husbands. However, suppressing the same, she married 2/6

the petitioner. The petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He has no previous cases at his credit. He would further submit that the co-accused was already granted bail by this Court. Therefore, prayed to grant bail for the petitioner.

4. The learned Counsel for State of Tamil Nadu (Crl.Side) appearing for the respondent would submit that due to the assault made by the petitioner, the deceased died. He would further submit that though most part of the investigation is completed, except the report of Voice Message, considering the grave nature of offence, he strongly opposed to grant bail to the petitioner.

5.Considering the above facts and circumstances, nature of offence levelled against the petitioner and also the facts that the petitioner is in judicial custody from 22.04.2026 and that the petitioner is not having any bad antecedents, this Court is inclined to grant bail to the petitioner subject to the following conditions: 3/6

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Thanjavur.

(i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the respondent Police daily at 10.30 a.m., until further orders;

(iii)the petitioner shall not tamper with evidence or witness;

(iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

(vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023. (K M S J) 27.05.2026 PNM TO
