ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 318(4) and 351(3) of BNS, in Crime No.476 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that certain gold jewels were entrusted with the petitioner by the defacto complainant to hand over the same to his wife. But, the petitioner failed to hand over the same to the defacto complainant's wife and cheated him. When the defacto complainant questing the same, the petitioner threatened him with dire consequences. Hence, the case.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that due to matrimonial dispute, the defacto complainant and his wife are living separately. The petitioner is a relative to 2/7

the defacto complainant's wife and therefore, this complaint has been lodged in order to harass the petitioner.

4.The learned Counsel for State of Tamil Nadu (Crl. side) appearing for the respondent police would submit that the petitioner is having one previous case for the offence under Section 318(4) of BNS.

5. The learned counsel appearing for the petitioner would submit that the previous case is for the recovery of rent arrears, wherein, the parties have already entered into a compromise and a petition has also been filed for quashing the complaint and the same is pending.

6.Considering the fact that the petitioner is a relative of the defacto complainant's wife and there existed a matrimonial dispute between the defacto complainant and his wife and also taking note of the charges levelled against the petitioner, this Court is inclined to grant anticipatory bail to the 3/7

petitioner with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.VI, Madurai, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;

[b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of one month and thereafter, as and when required for interrogation;

[c]the petitioner shall not tamper with the evidence or witness either during investigation or 4/7

trial;

[d]the petitioner shall not abscond either during investigation or trial;

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS, 2023. (K M S J) 27.05.2026 ogy TO
