ORDER
This writ petition is filed challenging the order passed by the first respondent vide his proceedings in Personnel Administration Department, PAD/C-01/2018-19 dated 30.03.2019 and quash the same and consequently direct the respondents to pay the pension and gratuity to the petitioner within a time frame. 2.The petitioner was appointed as an Officer in the erstwhile Pandyan Grama Bank, on 06.07.1987. He was issued with charge memo dated 05.04.2011. Pending disciplinary proceedings the 2/6
petitioner has attained superannuation, on 31.03.2019. However, he was retained in service by the order impugned in this writ petition dated 30.03.2019. Therefore, the petitioner is before this Court.
3.The learned counsel for the respondents, based on the written instructions, submits that on 24.12.2024, the management of the Bank, after obtaining due approval from the Board of Directors, passed a formal resolution to discontinue and drop all further departmental/disciplinary proceedings pending against the petitioner. This decision was taken considering the conclusion of the related judicial proceedings and the elapsed period since his retirement. Consequent to the above decision, the petitioner has been formally permitted to retire from service on attaining the age of superannuation as on 31.03.2019. His retirement status has thus been regularized in accordance with the service rules and bank regulations. He further submits that following the closure of proceedings and regularization of retirement, all terminal benefits, 3/6
which are all lawfully entitled to the petitioner, have been released and settled in his favour, in the month of January 2025. The Bank has, therefore, complied with its financial and statutory obligations pertaining to the retirement dues of the petitioner. He also submits that the petitioner has now been extended all admissible retirement benefits in full. The arrears of pension and related dues for the period from 01.04.2019 to 30.11.2024, amounting to a total sum of Rs.21,48,090/-, have been duly disbursed to the petitioner. Additionally, the gratuity amount of Rs.10,37,492/- was released and credited to the petitioner's account in the month of January 2025. Since then, the petitioner has been receiving regular monthly pension without any interruption. The most recent pension amount of Rs. 37,298.53/- has been credited towards the month of November, thereby demonstrating that the Bank has fully complied with its obligations regarding the Petitioner's post-retirement entitlements. 4/6
4.In view of the above submissions of the learned counsel for the respondents, this writ petition is disposed of. No costs.
