ORDER

The above writ petition has been filed for issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned tender cum auction notice issued by the fourth respondent published in Thina Thanthi Daily News paper, dated 20.06.2023, with regard to the sale of Sesame oil packet at A/m.Suyambu Saneeswara Bagavan Temple, Kutchanur, Theni District vide Fasali-1433 for the period of 01.07.2023 to 30.06.2024 and quash the same as illegal and consequently, direct the fourth respondent to give the time till 30.12.2023 for repayment of the balance amount of Rs.41 lakhs (Forty One lakhs).

2. Today, an affidavit has been filed by the petitioner stating that he will tender the balance sum of Rs.41,00,000/- (Rupees Forty One Lakhs) on or before 08.07.2023. The respondents have no objection to the same, provided the amount is paid before the said date.

3. Therefore, this Writ Petition is disposed of recording the undertaking affidavit. It is further made clear that if the amounts are not paid by 08.07.2023, on 09.07.2023, the respondents shall proceed with the auction. It is needless to state that the order will be complied with by the petitioner, even if he does not receive the order copy. No costs.
