ORDER

Mr.R.Anand, learned counsel appearing for the petitioner would submit that the petitioner is an octogenarian and a native of Thoothukudi and he has been presently living at Chennai. During the year 1981, he has 1/4

purchased a housing property in Sankaraperi Village from one Annamalai Chettiar and the original documents are in his possession. Taking advantage of the absence of the petitioner, one Valarmathi claiming to be the daughter of the petitioner, had created the documents, namely, the Death Certificate and the Legal Heirship Certificate, as if the petitioner has passed away. Based on that, she had sold the property to own Vigneshwaran. Coming to know of the same, the petitioner had given an objection to prevent further registration of the property, based on which, the SRO, Thoothukudi had issued a refusal slip in RFL/No.1 dated 07.05.2026.Thereafter, the said Vigneshwaran, without impleading the petitioner as a necessary party, has filed W.P(MD)No.14143 of 2026 before this Court challenging the refusal slip and obtained an order behind his back to direct the Sub Registrar to register the sale deed in favour of one Selvaraj and thereby the petitioner is constrained to file a Writ Appeal as a third party and he would seek for leave.
