ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 of IPC and r/w Section 4(1)(1A), 21(1) of Mines and Minerals Act, 1957 in Crime No.143 of 2018, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 24.06.2018, the petitioner has illegally transported the river sand without valid permission. Hence, a case has been registered.

3. Heard the learned counsel appearing for the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having seven previous cases.

5. It is seen from the records that on earlier two occasions, this criminal original petition was dismissed. Since there is no change in circumstance, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed with cost of Rs.5000/-(Rupees five thousand).
