ORDER : The Court Made the following order :- The petitioner is in judicial custody since 18.05.2018 for the offence punishable under Sections 5(m) and 6 of the Protection of Child From Sexual Offences Act, 2012 and 506(ii) of IPC, in Crime No.84 of 2018, on the file of the respondent police. He seeks bail.
2. The case of the prosecution is that the petitioner is said to have took the victim girl, who is aged about 7 years and gave sexual harassment to her. Hence, the complaint.
3. The learned counsel for the petitioner would submit that there is no evidence for committing any sexual harassment on the victim girl. He would further submit that he is an incarceration in prison from 18.05.2018. Hence, he prays for grant bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner committed the offence on the 7 years old girl. He would further submit that the investigation is completed and charge sheet laid in Spl.S.C.No.16 of 2018, on the file of the learned Mahila Court, Pudukkottai. Therefore, he vehemently opposed to grant bail and also sought for a direction to the speedy disposal of the trial. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the above facts and circumstances, the petitioner involved in heinous crime. Therefore, this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal Original Petition is dismissed. Further, considering the seriousness of the offence, this Court deems it fit to direct the trial Court to complete the trial within a period of six months from the date of receipt of a copy of this order.
7. The Registry is directed to send a order copy before the trial Court immediately.
