O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted seeking a direction to the respondents 1 to 3 to take appropriate action against the encroachments and to ensure that the public pathway is maintained without obstruction in accordance with the civil court decree.

2. Learned Additional Government Pleader appearing for the

respondents 1 to 3, based on the status report filed by the Tahsildar, submitted that the entire subject land has been classified as "Grama Natham" and "Pathway" and there is no obstruction in respect of the land belongs to the petitioner. That apart, 01 Cent of land was already assigned to the occupants under the Revenue Standing Order 21 and those persons are landless poor people and there is no impediment for the Government to grant free house site patta to them to the maximum extent of 03 Cents. Since 01 Cent of land alone has been assigned to the landless poor people, they cannot be considered as encroachers.

3. In view of the above submission, the relief as such sought for in this writ petition cannot be granted and the same is, therefore, dismissed. No costs.
