Writ Petition filed under Article 226 of the constitution of India, seeking for the issuance of Writ of Mandamus directing the respondents to pay a compensation of Rs.1,00,00,000/- (Rupees One Crore Only) to the petitioner for illegal prosecution, false implication, mental agony and violation of fundamental rights, based on the acquittal in CrlA(MD)No.276 of 2019 dated 03.12.2024. ORDER

The petitioner is an accused in SC.No.38 of 2016 on the file of the Fast Track Mahila Court, Virudhunagar. He has moved this petition seeking a direction to the respondents to pay a compensation of Rs.One crore that he has been maliciously prosecuted and he has been acquitted by the trial Court.

2.The learned Additional Public Prosecutor submits that the petitioner has been acquitted on the benefit of doubt. 3.The grant of compensation can be decided only by a civil court by adducing evidence. The petitioner is having remedy of filing a civil suit for malicious prosecution.

4.Since the petitioner is having an alternate remedy of filing civil suit, this petition is dismissed. No costs.
