Stalin, S/o.Shanmugam, aged about 29 years, life convict, PID No.189114 confined at Central Prison, Trichy.

O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the impugned proceedings of the first respondent made in No.540877/ThaKu.4/2026, dated 18.05.2026 and for a direction to the respondents to grant six days emergency leave to the petitioner's brother, who is a life convict presently serving sentence at Central Prison, Trichy.

2. Heard the learned counsel for the petitioner and the learned counsel for the State of TN (Crl.Side) appearing on behalf of the respondents.

3. The petitioner submitted a representation seeking emergency leave on the ground that the mother of the convict suffered serious ailment

and she required the physical and emotional support of the convict. The said representation made by the petitioner came to be rejected by the first respondent through the impugned proceedings, dated 18.05.2026 based on the report given by the Probation Officer to the effect that the mother of the convict does not suffer from any serious ailment. Aggrieved by the same, the present Writ Petition has been filed before this Court.

4. The learned Counsel for the State of TN (Crl.Side) brought to the notice of this Court that the convict has undergone sentence of 4 years and 15 days till now and that the convict was granted emergency leave on two occasions and ordinary leave on one occasion.

5. Taking into consideration the facts and circumstances of the case and considering the medical certificate that has been relied upon by the petitioner and also taking note of the fact that the convict was earlier granted leave and nothing untoward took place, this Court is inclined to interfere with the impugned proceedings of the first respondent, dated 18.05.2026 and the same is hereby set aside. There shall be a direction to the first respondent to grant six (6) days emergency leave to the convict

subject to the condition that the convict will report before the third Police Station daily at 5.00 PM during the entire emergency leave period.

6. This Writ Petition (Criminal) is allowed with the above directions. No costs.
