Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 3rd respondent vide proceedings in RO-TRY/197/2026-CA, dated 12.05.2026, consequently grant 28 days ordinary leave without Police escort to the petitioner's father namely Shanmugam, S/o.Peramaiya Nattar (PID No.66640), confined at Central Prison, Tiruchirappalli forthwith considering the petitioner's representation dated 27.03.2026.

O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the proceedings of the 3rd respondent made in RO-TRY/197/2026-CA, dated 12.05.2026 and for a consequential direction to the respondents to grant 28 days ordinary leave without Police escort to the petitioner's father, who is a life convict serving sentence at Central Prison, Tiruchirapalli.

2. Heard the learned counsel for the petitioner and the learned counsel for the State of TN (Crl.Side) appearing on behalf of the respondents.

3. The petitioner's father is a life convict, who has served a sentence of 5 years, 4 months and 25 days till date. A representation was made by the petitioner seeking ordinary leave on the ground that the wife of the convict was suffering from serious ailments and she required the physical and emotional support of the convict. The said representation came to be rejected by the 3rd respondent on the ground that there is one pending case against the convict, through proceedings dated 12.05.2026. Aggrieved by the same, the present Writ Petition has been filed before this Court.

4. It is brought to the notice of this Court by the learned counsel for the State of TN (Crl.Side) that the convict was earlier granted emergency leave on four occasions and ordinary leave on two occasions and that the convict has undergone sentence of 5 years, 4 months and 25 days till date.

5. Taking into consideration the facts and circumstances of the case and considering the reason for which the ordinary leave has been sought for and also taking note of the fact that the convict was earlier granted leave and nothing untoward took place, this Court is inclined to interfere with the impugned proceedings of the 3rd respondent, dated 12.05.2026 and accordingly, the same is hereby set aside. There shall be a direction to the 3rd respondent to grant 28 days ordinary leave to the convict subject to the condition that the convict will report before the 5th respondent Police daily at 5.00 PM during the entire ordinary leave period.

6. This Writ Petition (Criminal) is allowed with the above directions. No costs.
