Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the respondents to consider the petitioner's representation dated 16.06.2014 which is acknowledged by the office of the first respondent and assigned Petition Number as AI/14/03519, vide proceedings No.Na.Ka.A3/9067/2014, dated 16.06.2014 and consequently, direct the second respondent to conduct an enquiry for giving an appointment under compassionate ground to the petitioner and pass an appropriate order on merits and in accordance with law within the stipulated time. O R D E R

The petitioner has come to this Court seeking a direction to the respondents to consider the petitioner's representation, dated 16.06.2014, which is acknowledged by the Office of the first respondent and consequently, direct the second respondent to conduct an enquiry for giving an appointment under compassionate ground to the petitioner.

2. The petitioner's father Late Thangaraj while serving as Village Assistant in Inanganur Village, died on 02.01.2013, leaving behind the petitioner and his younger brother Mohan as his legal-heirs. Immediately, after the death of his father, an application was submitted on 16.06.2014, before the District Collector, Karur, along with death certificate of his father Late Thangaraj, death certificate of his mother Rooth, legal-heirship certificate, consolidated certificate for seeking appointment under compassionate ground by the second respondent, poverty certificate, transfer certificate, SSLC Mark sheet, community https://hcservices.ecourts.gov.in/hcservices/

certificate and ration card for perusal of the respondents. Since no such person in his family is employed in Government service, the District Collector, Karur also considering the plight of the petitioner's family, has given a direction to the second respondent, Tahsildar, Aravakurichi Taluk, Karur District to conduct an enquiry and send a report for appointing the petitioner under compassionate ground. Although the said direction was issued by the District Collector, Karur on 23.06.2014, it is complained before this Court that the second respondent, Tahsildar, till date has not acted upon the same, when the petitioner had already lost his both parents, based on the direction given by the District Collector, Karur. Therefore, a suitable direction may be given to the second respondent to do the needful within the time stipulated by this Court.

3. The learned Government Advocate appearing for the second respondent submitted that the District Collector, Karur, has already given a direction to the Tahsildar, Aravakurichi, to send a proposal in favour of the petitioner.

4. As the record shows that the petitioner has already submitted all the requisite documents, based on which the District Collector, Karur, has also given a direction to the second respondent, the second respondent is further directed to act, on the direction given by the District Collector, Karr, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition stands disposed of. No costs.
