... Petitioner/Plaintiff vs.

1)Suganthi 2)N.Gopalakrishnan 3)Savurirajan 4)B.Santhalakshmi 5)N.Venkatramana Doss ... Respondents/Defendants Petition filed under Article 227 of the Constitution of India, to direct the trial Court, the Principal Sub Court, Pudukkottai, to dispose of the suit in O.S.No.257 of 2014 within a set time frame. For Petitioner : Mr.V.Singan

ORDER

The petitioner has filed this revision petition seeking direction for early disposal of the suit.

2.Learned counsel for the petitioner would aver among other things that the petitioner as plaintiff filed O.S.No.257 of 2014 before the Principal Sub Court, Pudukottai, for permanent injunction restraining the respondents/defendants from interfering with his peaceful possession and enjoyment of the suit property. The suit is in part heard stage and the after the closure of the plaintiff's side evidence, the suit was pending for more than 4 months for the defendants' evidence. According to the learned counsel, despite the fact that the defendants have disclaimed all their interests in the suit property, the defendants' counsel is prolonging the suit unnecessarily. Thus, he prays for direction for early disposal of the suit.

3.Considering the limited relief sought for, notice to respondents is not necessary.

4.Considering the facts and circumstances of the case and the fact that the suit for permanent injunction filed in 2014, is pending for more than 4 years, without adverting to the merits of the case, this Court is of the view that ends of justice would be met if a direction is issued for early disposal of the suit. Accordingly, a direction is issued to the learned Principal Sub https://hcservices.ecourts.gov.in/hcservices/ 1/2
