: Respondents Prayer : Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the Respondents 1 and 2 to conduct enquiry on the petitioner's complaint, dated 29.06.2022, for appropriate legal action under Vigilance and Anti Corruption Act, within a stipulated period as prescribed by this Court.

O R D E R

This petition is filed seeking direction to direct the respondents 1 to 3 to conduct enquiry, on the basis of the complaint, that has been given by the petitioner, on 29.06.2022.

2.The case of the petitioner is that he is working as watchman at Srinithi Fireworks situated at Keeltiruthangal, sivakasi Taluk, Virudhunagar District. One A.Chellasamy, who is working as Village Administrative Officer, Keelathiruthangal, Virudhunagar District, was continuously approaching the petitioner and make thereat that he will lodge false complaint against fireworks and lock the same also demanded a sum of Rs.50,000/- as bribe for not to proceed the matter. Because of the above said illegal action on the side of the person, he lodged a complaint, on 29.06.2022. But, that was not considered. Hence, this petition.

3.The learned Additional Public Prosecutor would submit that the above said complaint given by the petitioner is false one. As a counter blast, that complaint was presented against the above said VAO. Because, based upon the complaint given by VAO against Fireworks, already cases have been registered in Crime No.268 of 2022 on the file of the Sivakasi East Police 2/5

Station, Virudhunagar District. Another complaint was also registered against the Fireworks in Crime No.240 of 2022 because of the fire accident in the above said premises. In order to escape from the criminal case only, the above said accused person, who is the watchman, sent a complaint with false allegation, and vague.

4.The complaint given by the petitioner has been forwarded to the District Collector, Virudhunagar District, for taking necessary action. As per the procedure, 3 months time is available to the authorities to act upon the complaint against the above said VAO. The petitioner can wait for the above said time. But, it is seen that the complaint itself is false one and an act of vendetta.

5.With the above direction, this Writ Petition is disposed of. No costs.
