PRAYER :- This Second Appeal is filed under Section 100 of the Civil Procedure Code, to set aside the judgment and decree dated 27.09.2019 passed in A.S.No.14 of 2017 on the file of the Principal District Judge, Pudukottai by partly allowing the judgment and decree dated 09.01.2017 in O.S.No.97 of 2003 on the file of the Sub Court, Pudukottai and allow the Second Appeal. JUDGMENT

The appellant filed this appeal to set aside the judgment and decree dated 27.09.2019 passed in A.S.No.14 of 2017 on the file of the learned Principal District Judge, Pudukottai by partly allowing the judgment and decree dated 09.01.2017 in O.S.No.97 of 2003 on the file of the Sub Court, Pudukottai.

2. When the matter is taken up for hearing today (02.02.2024), the appellant as well as the respondents are present before this Court. Mr.D.R.Murugesan, learned counsel appearing for the appellant and Mr.H.Lakshmi Shankar, learned counsel filed vakalat for all the respondents. The parties are identified by their respective counsel. The identity proof of the parties are also verified. Both the counsel for the appellant and respondents filed a Joint Compromise Memo, which was signed by the appellant and the respondents. The contention of the Joint Compromise Memo was read over and explained to both parties in the presence of their counsel and both parties have agreed for the terms of the compromise. The said compromise memo is recorded.

3. Hence, this Second Appeal is disposed of as per the terms of Joint Compromise Memo. The Joint Compromise Memo shall form part of the decree. No costs.
