O R D E R
The writ petition has been filed seeking a direction to the respondents 1 to 3 to grant permission and police protection to the petitioner for conducting Vadakkuvasi Amman Temple festival at Bolakkapatti, on the first Tuesday of Tamil Purattasi month, based on the conclusion arrived at in the peace committee held by the 1st respondent on 06.04.2015 and his representation dated 29.08.2016.
2. Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal. In view of the order to be https://hcservices.ecourts.gov.in/hcservices/
passed in this petition, notice to the 4th respondent is dispensed with.
3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
4.The learned counsel appearing for the petitioner would submit that the petitioner and his family members have been ancestrally conducting poojas and celebrating festival in the said temple every year on the first Tuesday of Tamil Purattasi month; last year on the basis of the peace committee meeting held on 06.04.2015, the petitioner was permitted to perform the function; a representation was given to the official respondents seeking permission and police protection for this year celebration, but however, the same was not considered by the official respondents so far and hence, the petitioner is before this Court with this writ petition.
5.The learned Additional Government Pleader appearing for the respondents, on instructions, gave an undertaking that the official respondents would consider the representation of the petitioner, dated 29.08.2016, on merits and in accordance with law.
6.In view of the above undertaking given by the learned Additional Government Pleader, the respondents 1 to 3 are directed to consider the representation of the petitioner dated 29.08.2016 after giving an opportunity of hearing to the petitioner, 4th respondent and other necessary parties and pass appropriate orders on merits and as per law within a period of two weeks.
7. With the above direction, the Writ Petition is disposed of. No costs.
