For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the Petitioner on bail in the event of his arrest in Crime No. 659/2019 on the file of the Respondent and thus render justice.

ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences under Sections 406 and 420 IPC in Crime No.659 of 2019 on the file of the Inspector of Police, Rajapalayam South Police Station, Virudhunagar District. He seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police. 1/3

3.It is a case of job racketing. The petitioner is said to have received a sum of Rs.2,13,000/- from one of the victims. The petitioner's counsel states that two of the co-accused were granted anticipatory bail and that they are being directed to pay the amount. This Court suggested to the petitioner's counsel that if the petitioner is willing to deposit the amount received by him from the defacto complainant, this Court would consider this petition. The petitioner's counsel undertakes through his client to deposit the said amount within a period of three weeks from the date of receipt of a copy of this order.

4.Subject to the above said condition and recording the submission of the learned counsel for the petitioner, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Rajapalayam and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and he shall appear before the respondent police for a period of three weeks and thereafter, he shall appear before the respondent police as and when required for interrogation.

5.The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed. sd/- 03/09/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.)
