ORDER : The Court Made the following order :- The petitioner/A2 apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 of I.P.C., in Crime No.646 of 2018, seeks anticipatory bail. 2.

The case of the prosecution is that the defacto complainant and his friends viz., Senthil Kumar, Salesman Saravanan and the petitioner went to Tenkasi to deliver silver ornaments and to collect the money from the retail shop and on 11.08.2018, the defacto complainant directed the Saravanan and the petitioner to rerutn to Madurai and handover Rs.6,00,000/- and 6.5 kg silver old ornaments to his brother's home. But, however, after return to Madurai, the Salesman informed that the said sum was missed and when he enquired about the cash to the petitioner and Salesman, they told that they are not aware of the same and hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. 4.

The learned Government Advocate (criminal side) submitted that the investigation is pending.

https://hcservices.ecourts.gov.in/hcservices/ 5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain

conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.1, Madurai and each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
