RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the sentence imposed by the Learned Judicial Magistrate No.I, Trichy in C.C.No.173/2012 dated 19/08/2017 which was confirmed in C.A.No.81/2017 on the file of the Principal Sessions Court, Trichy dated 07/07/2018 pending disposal of the above Crl.R.C.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.C.VAKEESWARAN, Advocate for the petitioner and of MR.A.ROBINSON, Government Advocate (Crl.Side)on behalf of the Respondent, while admitting the Crl.RC., the court made the following order:- The petitioner has been convicted for an offence under Section 304(A) I.P.C., and sentenced to undergo simple imprisonment for a period of 4 months and pay a fine of Rs.1,000/- (One Thousand Only) in default to undergo one month simple imprisonment. 2.The learned counsel for the petitioner has raised various grounds in this revision in order to substantiate the points available in favour of the petitioner. This Court will not be able to hear this petition in the near future.
In the facts and circumstances of the case, the sentence imposed by the learned Judicial Magistrate, No.I Trichirappalli, in C.C.No.173 of 2012, dated 19.08.2017 is hereby suspended, pending disposal of the Criminal Revision on the following conditions: https://hcservices.ecourts.gov.
(i) the petitioner is directed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand Only)to the credit of C.C.No.173 of 2012, on the file of the learned Judicial Magistrate No.I, Trichirappalli. (ii) the petitioner is directed to execute the bond for a sum of Rs.10,000/- to the satisfaction of the learned Judicial Magistrate No.I, Trichirappalli, with one surety for a likesum. (iii)the petitioner is directed to appear before the Court below once two months on the first working day, pending disposal of the Criminal Revision Petition.
