For Respondent : Mr.M.Karunanithi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition No.7(b) imposed in Crl.OP(MD).No.9016 of 2025 dated 22.05.2025 .

ORDER : The Court Made the following order :- 1/4

This petition has been filed to modify the condition No.7(b) imposed in Crl.OP(MD).No.9016 of 2025 dated 22.05.2025.

2. The learned counsel for the petitioner would submit that the petitioner is the accused in Crime No.228 of 2025, he filed an anticipatory bail application before this Court on 20.05.2025 in Crl.OP.(MD).No.9016 of 2025. The said anticipatory bail petition was heard and ordered on 22.05.2025, this Hon'ble Court was pleased to grant anticipatory bail to the petitioner with certain conditions. In the said bail order, Condition No.7(b) is as follows:

''7(b). The petitioner shall report before the respondent police daily at 10.30a.m. for a period of 30 days and thereafter, as and when required for interrogation''.

3. He further submits that the respondent police harassed the petitioner and also threatened the petitioner by foisting false case against the petitioner. The petitioner has complying with the condition nearly 10 days. Now, the petitioner filed this present petition to modify the said condition No.7(b) and requested to change the reporting police station in the very same district for the remaining period. Hence, he prays for modification of the said condition No.7(b).

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioner has complied with the condition for nearly 10 days. 2/4

The learned Government Advocate (Crl.Side) has not raised any objection to allow this Criminal Miscellaneous Petition.

Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated in the accompanying affidavit, this Court is inclined to modify the Condition No.7(b) imposed in the order made in Crl.O.P(MD).No.9016 of 2025 dated 22.05.2025. Accordingly, Condition No.7(b) is modified as ''7(b). The petitioner shall report before the Inspector of Police, Tenkasi Police Station, Tenkasi District daily at 10.30a.m. for the remaining period and thereafter, as and when required for interrogation.''. The other conditions shall remain unaltered.
