PETITION FOR ANTICIPATORY BAIL UNDER SECTION 482 OF BNSS COMMON PRAYER :- For Anticipatory Bail in Crime Nos. 186 & 187 of 2024 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 294(b), 323, 324, 506(i) of IPC and 294(b), 323,324,355 & 506(ii) of IPC in Crime Nos. 186 & 187 of 2024 respectively, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution in Crime No.186 of 2024 is that on 06.06.2024 at about 11 a.m, the accused 1,2 and 4 had created an issue before the Sub Registrar, Guziliamparai, where, the defacto complainant appeared and explained about the document in dispute, while being so, the accused 1,2 & 4 attacked the defacto complainant and the petitioners in Crl.OP(MD) No.10572 of 2024 herein intimidated them. Hence, the case in Crime No.186 of 2024. 3.The case of the prosecution in Crime No.

187 of 2024 is that the property in S.No.1744/7A to an extent of 23 1⁄4 cents at Gujiliamparai belongs to the defacto complainant. The petitioners in Crl.OP(MD) No.

and the same was questioned by the defacto complainant, for which, the petitioners abused him in filthy language and also assaulted him. Hence the case in Crime No.187 of 2024.

4.Considering the nature of allegations and also considering the fact that the alleged occurrence had taken place in front of Sub Registrar / a public place, this Court has dismissed the earlier application filed by these petitioners. 5.Though the earlier applications of these petitioners have been dismissed on 13.06.2024 and 12.06.2024 respectively, the respondent police is not in a position to secure the petitioners, which enables the petitioners to file the application for anticipatory bail repeatedly. In order to save the time of this Court, this Court is inclined to grant anticipatory bail to these petitioners. 6.

Accordingly, these criminal original petitions are allowed and the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Judicial Magistrate Court ,Vedasandur, on condition that the petitioners shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court ,Vedasandur and on further conditions that: i.

or any other identity card issued by the Government in proof of their residence address;

ii. The petitioners shall appear before the respondent police daily at 10.30 a.m, until further orders.

iii. The petitioner shall not misuse the liberty granted to them by indulging in any further offence and shall not tamper with the prosecution witnesses. The petitioners shall be available for the trial as well. iv. On violation of any of the above conditions by the petitioners, the respondent police shall move an application for cancellation of the anticipatory bail.
