RESPONDENT/RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition imposed by this Honourable Court in Crl.OP(MD) No.9884/2019 in W.L.O.R.No.2/2019 on the file of the respondent dated 17.07.2019.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.B.N.RAJA MOHAMED, Advocate for the petitioner and of Mr.V.Neelakandan, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The petition has been filed to modify the condition imposed on the petitioner in CRL OP(MD) No.9884 of 2019.
2. The learned counsel for the petitioner would submit that while granting bail, this Court by the order dated 17.07.2019, has directed the petitioner to appear before the respondent, but in the said order it has been mistakenly stated as respondent police and hence initially the respondent refused to get signature from the petitioner and only after convinced by the counsel for the petitioner , the respondent got signature . He further submitted that the petitioner is already having one previous case before the learned Judicial Magistrate, Thoothukudi and he is also a heart patient and taking treatment at Thoothukudi. CRL MP(MD) No.6783 of 2019 appear before the respondent.
3. The learned Additional Public Prosecutor would submit that the petitioner has complied with the condition for 9 days.
4. Taking into consideration the aforesaid facts, Registry is directed to make corrections in the order passed by this Court in Crl.O.P(MD) No.9884 of 2019, wherever it is mentioned as respondent police that should be corrected as respondent. Further the condition imposed by this Court is modified to the effect that the petitioner shall appear before the Forest Ranger, Thoothukudi daily at 10.00 am for a period of three weeks and thereafter before the respondent as and when required for interrogation and issue fresh copy. All other conditions imposed by this Court in the said order shall remain unaltered.
