Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus to direct the Respondents No.1 to dispose the Revision Petition dated 02.02.2016 filed by the Petitioners and cancel the Patta granted infavour of the Respondent No.4 and consequently direct the Respondents No.1 to 3 to restore the name of the Petitioners in the revenue records in Patta No.792 in survey Nos.294/3A, 309/5, 293/5, 294/3C, 294/5A, 294/5C, 295/2, 294/15B, 294/15A2, 293/6A, 293/7A, 293/6C, 293/7C, 293/8A, 293/8C, 293/9 situated at Chitharkalnatham Village, Nilakottai Taluk, Dindigul District within the time framed fixed by this Hon'ble Court. The petitioners seek for a mandamus to direct the Respondents No.1 to dispose the Revision Petition dated 02.02.2016 filed by the Petitioners and cancel the Patta granted in favour of the Respondent No.4 and consequently direct the Respondents No.1 to 3 https://hcservices.ecourts.gov.in/hcservices/
to restore the name of the Petitioners in the revenue records in Patta No.792 in survey Nos.294/3A, 309/5, 293/5, 294/3C, 294/5A, 294/5C, 295/2, 294/15B, 294/15A2, 293/6A, 293/7A, 293/6C, 293/7C, 293/8A, 293/8C, 293/9 situated at Chitharkalnatham Village, Nilakottai Taluk, Dindigul District within the time framed fixed by this Court.
2. Heard the learned counsel appearing for the petitioners and the learned Additional Government Pleader, who takes notice for the respondents 1 to 3.
3. Needless to say that it is for the first respondent to dispose of the said revision after giving opportunity of hearing to the petitioners as well as the rival claimants, if any and pass orders on merits and in accordance with law.
4. Therefore, without expressing any view on the claim made by the petitioners, the first respondent is directed to dispose of the revision filed by the petitioners after giving opportunity of hearing to the petitioners as well as the rival claimants, if any and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
