ORDER

The petitioner seeks the early disposal of an appeal filed and pending before the first respondent.

2. The petitioner claims title to the property bearing Survey No.104/3 of an extent of 50 cents in Kannanmangalam Village, Ilayangudi Taluk. In support of such contention, the petitioner relies upon Patta No.551 issued in his name. Subsequently, it is stated that the petitioner discovered that a patta had been issued in the name of one Fathima Beevi as regards Survey No.104/3 under Patta No.1486. Therefore, the petitioner filed an appeal before the first respondent, which was numbered as Na.Ka.No.A36647/2013. The petitioner states that notice was issued in such appeal on 13.11.2013 and, in fact, the respondents filed a counter in July 2014. The present Writ Petition is filed seeking the expeditious disposal of such appeal.

3. Mr.K.S.Selva Ganesan, learned counsel for the State, accepts notice on behalf of both the respondents. On instructions, he submits that the said appeal is next listed for hearing on 22.09.2021.

4. Given the limited scope of the present petition, it is not necessary to delve into the merits of the dispute. Instead, it is sufficient if the first respondent is directed to dispose of the appeal expeditiously.

5. Therefore, the first respondent herein is directed to dispose of the appeal bearing Na.Ka.No.A36647/2013 within a period of three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and all the other parties to the relevant appeal.

6. Accordingly, W.P.(MD).No.16359 of 2021 stands disposed of on these terms without any order as to costs.
