This petition has been filed, seeking to direct the 2nd respondent herein to look into the grievance of the petitioner expressed in the representation, dated 31.08.2016 and thereby accord permission to conduct the "Vinayagar Chadurthi Festival" by and to provide adequate police protection from 09.09.2016 to 11.09.2016 at festival place in front of the Nallai Selva Vinayagar Kovil at Poovanoor, Pavoorchatriam, Tirunelveli District and to give necessary police protection to the said programme.
2. Mr.K.P.Krishnadoss, learned Government Advocate, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.
4. The learned counsel appearing for the petitioner would submit that the Vinayagar Chathurthi festival is being conducted by the villagers regularly in order to promote harmony among https://hcservices.ecourts.gov.in/hcservices/
public; that a representation was given to the respondents, but, however, the same was not considered by the respondents so far and hence, the petitioner is before this Court with this writ petition.
4.1. The learned counsel appearing for the petitioner would further submit that as the Vinayagar Chathurthi festival is conducted in a peaceful manner by the villagers, there will be no untoward incident on account of this festival.
5. The learned Government Advocate for the respondents would submit that the representation of the petitioner dated 31.08.2016 will be considered and suitable orders will be passed thereon.
6. Once a representation has been received by the respondents, it is their bounden duty to decide on the same in one way or the other. Therefore, the second respondent is directed to consider the representation of the petitioner dated 31.08.2016 and pass appropriate orders thereon taking into account the law and order problem and other aspects, prevailing in that area, well before the date of function.
With the above direction, this Writ Petition is disposed of. No costs.
