Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to accord permission and protection for enabling the petitioner so as to remove the Seemai karuvelam tress (Juliflora trees) from the properties in Survey Nos.400/2F,437/3C, 437/8 and 441/1 Patta No.486, Suppaniendhal Village, Pullamadai Group, R.S.Mangalam Firka, Thiruvadanai Taluk, Ramanathapuram District.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to give necessary permission and protection so as to enable the petitioner to remove Seemaikaruvelam trees in Survey Nos.400/2F,437/3C,437/8 and 441/1 Patta No.486, Suppaniendhal Village, Pullamadai Group, https://hcservices.ecourts.gov.in/hcservices/

R.S.Mangalam Firka, Thiruvadanai Taluk, Ramanathapuram District, by way of issuing a writ of mandamus.

2.Mr.M.Govindan, learned Special Government Pleader, has taken notice for the respondents.

3.It is seen from the records that the third respondent has already issued a notice dated 27.03.2017, wherein it has been specifically directed the petitioner to remove Seemaikaruvelam trees standing in the survey numbers mentioned therein. Under the said circumstances, this writ petition has been filed. 4.The learned Special Government Pleader appearing for the respondents has represented to the effect that already a civil suit is pending. Under the said circumstances, this Court is inclined to pass the following order.

5.In fine, the third respondent is directed to conduct a Peace Committee Meeting with regard to removal of Seemaikaruvelam trees. With the above observation, this writ petition is disposed of. No costs.
